A resident of northwest Miami-Dade, who is 82 years old, has been charged with two felonies for allegedly assaulting her neighbor on two separate occasions. According to the police, the woman attacked her neighbor for trimming a tree, and in the most recent incident, she used pepper spray.
Mary Elizabeth Sutton was reported to have hit her 65-year-old neighbor in the face with a stick on August 30, 2023. The incident took place while he was cutting a tree that was growing over the chain-link fence separating their residences. As a result, the victim suffered from facial swelling.
Sutton’s residence is located in the 200 block of Northwest 105th Street, which is situated just outside of Miami Shores.
According to police, in the second incident, Sutton sprayed her neighbor in the face with pepper spray after he once again was trimming the tree from his property. The authorities were alerted around 11 a.m on Wednesday and responded to the scene.
According to police, the victim received treatment from Miami-Dade Fire Rescue right at the location.
According to the arrest report, Sutton expressed to the police that her neighbor had no authority to trim the tree on his property. However, she did not disclose anything about using pepper spray.
According to authorities, they discovered a probable cause message to detain her for the incident that occurred on Aug. 30, as well as the incident that took place on Wednesday, after conducting a records check.
As of Thursday morning, Sutton remained in custody at the Turner Guilford Knight Correctional Center on a bond of $3,000.
The judge in Miami-Dade has determined that there is enough evidence to charge the elderly individual with two counts of battery on a person aged 65 or older, which is considered a third-degree felony.
